These Terms of Service (“Terms”) form a binding agreement between you and the operator of Fortune Smash Gala. By installing or continuing to use the Application, you agree to these Terms.
You must be at least 13 years old to use Fortune Smash Gala. If you are not of legal age where you live, a parent or guardian must accept these Terms on your behalf.
Fortune Smash Gala is a mobile smash-and-gala entertainment experience featuring prize smash interactions, event rounds, and optional promotions or advertising. Features, events, and reward rules may change, pause, or end at any time.
Your use is also governed by our Privacy Policy, which explains how we collect, use, and share personal data (including processing related to https://xoul.fosmga.com). By using the Application, you acknowledge that you have reviewed it.
You may not:
https://xoul.fosmga.com or partner systemsSoftware, artwork, trademarks, smash assets, gala themes, event materials, and other content in the Application belong to us or our licensors. You receive a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial play under these Terms.
The Application may integrate advertising, analytics, and payment partners. Their own terms and privacy policies apply. We are not responsible for third-party content or practices outside our control.
We may suspend or terminate access if we reasonably believe you violated these Terms, engaged in fraud or abuse, or pose a risk to users or the platform. You may stop using the Application at any time by uninstalling it.
PayPal: Withdrawal information is used only for payouts, fraud prevention, and legal compliance — never sold for third-party marketing.
The Application is provided “as is” and “as available” without warranties of uninterrupted or error-free operation to the fullest extent permitted by law.
Rewards and withdrawals are not wages or guaranteed income. Past results do not guarantee future outcomes.
To the maximum extent permitted by law, we and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Application.
Where liability cannot be excluded, our total liability is limited to the greater of (a) amounts you paid us in the 12 months before the claim or (b) USD $50, except where mandatory consumer protection laws provide otherwise.
You agree to indemnify and hold harmless Fortune Smash Gala, its operators, and affiliates from claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Application, violation of these Terms, or infringement of third-party rights.
These Terms are interpreted under applicable law, including mandatory consumer protections in your jurisdiction. Before formal proceedings, contact oa@quijanoss.com to seek a good-faith resolution. Non-waivable consumer rights under local law are not limited by these Terms.
We may update these Terms as the Application or legal requirements evolve. Material revisions may be communicated in-app or by other reasonable means. Continued use after the effective date constitutes acceptance.
